Terms of Service

By subscribing to GoWebsited’s managed website service (“Service”), you (“Client,” “you,” “your”) agree to be bound by these Terms of Service (“Terms”). Please read them carefully. If you do not agree to these Terms, do not subscribe to or use the Service.

“GoWebsited,” “we,” “us,” and “our” refer to GoWebsited and its operators.

1. Service Description

GoWebsited provides a fully managed website service that includes custom website design and development, web hosting on GoWebsited-managed servers, domain registration and/or management (where applicable), search engine optimization (SEO), Answer Engine Optimization (AEO), and Generative Engine Optimization (GEO), ongoing website maintenance, software updates, and security monitoring, and monthly content edits within your plan’s included hours. Additional features such as blog writing, e-commerce functionality, quarterly strategy calls, and performance reports are available on higher-tier plans as described on our Pricing page.

2. Subscription Plans & Billing

Plans: GoWebsited offers three subscription tiers: Starter ($49/month), Professional ($99/month), and Business ($199/month). Features and included services for each plan are detailed on our Pricing page.

Setup Fee: A one-time setup fee of $299 applies to all monthly subscriptions. This fee is waived entirely for yearly subscriptions.

Yearly Plans: Yearly subscriptions receive two months free (pay for 10 months, receive 12 months of service). Yearly plans are billed upfront for the full year.

Billing: Monthly plans are billed automatically on the same date each month via Stripe. All fees are in US Dollars (USD). All fees are non-refundable except as explicitly stated in these Terms.

Failed Payments: If a payment fails, you have a 15-day grace period to update your payment method. During this period, your site remains live. If payment is not resolved within 15 days, your website will be taken offline by toggling DNS settings (we do not delete your files immediately).

3. Domain Ownership

If GoWebsited registers a domain on your behalf, that domain is the property of GoWebsited and is licensed to you for use during your active subscription. Upon cancellation, the domain remains with GoWebsited.

If you provide your own pre-existing domain, it remains your property. You grant GoWebsited DNS/nameserver access to manage the domain during your subscription.

4. Intellectual Property

Your Content: You retain ownership of all text, images, logos, and other materials you provide to us (“Client Content”). You grant GoWebsited a non-exclusive license to use Client Content solely for the purpose of building and maintaining your website.

Our Work: All website designs, code, layouts, templates, and structural elements created by GoWebsited (“GoWebsited IP”) are and remain the intellectual property of GoWebsited. GoWebsited IP is licensed to you for use on your website during your active subscription only. This license is non-transferable, non-sublicensable, and terminates upon cancellation.

5. Content & Acceptable Use

You are solely responsible for the accuracy, legality, and appropriateness of all Client Content. GoWebsited reserves the right to refuse to publish content that is unlawful, defamatory, infringing, obscene, promotes violence, or violates any third-party rights. We may remove such content without notice.

6. Edits & Additional Services

Each plan includes a specified number of monthly edit hours. Edit requests are submitted via our dedicated edit request form. Edits beyond included hours are billed at $75/hour or at a discounted rate of $199 for a 3-hour block. We will notify you before performing work that exceeds your included hours.

Add-ons (custom email, logo design, extra pages, live chat widget) are billed separately. Recurring add-ons are added to your Stripe subscription. One-time add-ons are invoiced via Stripe.

7. Cancellation & Data Export

You may cancel your subscription at any time by emailing support@gowebsited.com. Cancellation takes effect at the end of your current billing period. Your website will go offline after the billing period ends.

Data Export: Upon cancellation, you may request a PDF export of your website content at no cost. A full working export (WordPress files and database) is available for a fee of up to $299. Requests must be made within 30 days of cancellation.

After 30 days post-cancellation, GoWebsited may delete all website files, databases, and associated data.

8. Service Availability & Liability

GoWebsited strives for maximum uptime but does not guarantee uninterrupted service. We are not liable for downtime caused by hosting provider outages, DNS propagation delays, third-party service failures, force majeure events, or scheduled maintenance.

Limitation of Liability: To the maximum extent permitted by law, GoWebsited’s total liability for any claims arising from or related to the Service shall not exceed the total fees paid by you in the three (3) months immediately preceding the event giving rise to the claim. GoWebsited is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of revenue, data, or business opportunities.

9. Indemnification

You agree to indemnify, defend, and hold harmless GoWebsited and its operators, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your Client Content; (b) your breach of these Terms; (c) your use of the Service; or (d) any third-party claims related to your website. This indemnification obligation survives cancellation of your subscription.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

11. Modifications to Terms

GoWebsited reserves the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after notification constitutes acceptance of the updated Terms.

12. Governing Law & Disputes

These Terms are governed by the laws of the Province of Alberta, Canada. Any disputes arising from these Terms or the Service shall be resolved exclusively in the courts of Calgary, Alberta. Any legal action or claim must be brought within one (1) year of the event giving rise to the claim.
